Article 11 of the Turkish Personal Data Protection Law No. 6698 (“KVKK”) grants a number of rights to people whose personal data is processed (“data subjects”). Under KVKK Article 13 and the Communiqué on the Procedures and Principles of Application to the Data Controller (the “Communiqué”), you can apply to the data controller FİDKEEP TEKNOLOJİ TİCARET LİMİTED ŞİRKETİ (“Fidkeep”) to exercise these rights.
This page explains how to apply and contains the form you can use in your application. To use the form, copy the headings and fields in Sections 3 to 8 into your application and complete them. Information on how your personal data is processed is available in the KVKK Privacy Notice. This English version is provided for convenience; the Turkish version (İlgili Kişi Başvuru Formu) prevails in case of conflict.
1. Who can apply
Any natural person whose personal data is processed by Fidkeep can apply: Fidkeep account users and customer representatives, former users, website visitors, billing and payment contacts, support applicants, recipients of commercial messages and other data subjects.
The application is made by the data subject. If an application is made on behalf of someone else, a notarised power of attorney granting specific authority for this purpose, or a document evidencing parental custody or guardianship, must be attached.
For applications concerning your Google reviews that appear in a business's Fidkeep workspace, please read Section 12.
2. How to apply
Under Article 5 of the Communiqué, you can submit your application in Turkish by one of the following methods:
- In person or by post: By handing your application bearing your wet signature in person at Sarıgüllük Mah. Ali Nadi Ünler Bul. Milenyum Apt. No: 3A, Şehitkamil / Gaziantep, Türkiye, or by sending it by post or through a notary. We recommend writing “KVKK Kapsamında Bilgi Talebi” (Information request under the KVKK) on the envelope.
- By KEP: By sending it from your own registered electronic mail (KEP) address to [email protected].
- With a secure electronic signature or mobile signature: By signing your application with a secure electronic signature or mobile signature and e-mailing it to [email protected].
- From your registered e-mail address: By sending it to [email protected] from the e-mail address you previously provided to Fidkeep and that is registered in our systems. This method can be used, for example, for the e-mail address of your Fidkeep account. If you have no e-mail address registered with Fidkeep, please use one of the other methods.
For applications by e-mail, we recommend writing “KVKK Kapsamında Bilgi Talebi” in the subject line. You may attach information and documents relating to your request.
3. Applicant details
Under Article 5 of the Communiqué, the following information must be included in the application (telephone, fax and e-mail if available):
- First and last name: Required.
- Turkish identity number: Required for citizens of the Republic of Türkiye.
- Nationality and passport number, or identity number if any: Required for foreign nationals.
- Residential or business address for notifications: Required.
- E-mail address for notifications: If available.
- Telephone or fax number for notifications: If available.
- Your e-mail address registered with Fidkeep: If any; it helps us match your identity and records.
- Proxy or representative details: If the application is made on behalf of someone else, the representative's name and contact details and the document evidencing authority.
Information such as the identity number is processed only to verify your identity and conclude your application.
4. Your relationship with Fidkeep
So that we can match your request with the right records, please state the number of the option that applies to you:
- I am an account user or customer representative using the Service on behalf of a Fidkeep customer.
- I am a former user; my account was closed or I was removed from a workspace.
- I am a website visitor.
- I am a billing or payment contact.
- I received a commercial message from Fidkeep or talked to Fidkeep as a prospective customer.
- A review I wrote about a business on Google appears in that business's Fidkeep workspace.
- I applied for a job.
- Other (please explain).
If you selected option 6, please state the name and location of the business you reviewed, the display name you use on Google and, if possible, the link to the review.
5. Subject of the request
Please state the number of the right or rights under KVKK Article 11 that you wish to exercise (you may select more than one):
- I want to learn whether my personal data is processed.
- I request information about the processing if my personal data has been processed.
- I want to learn the purpose of the processing of my personal data and whether it is used in line with that purpose.
- I want to know the third parties in Türkiye or abroad to whom my personal data is transferred.
- I want my incomplete or inaccurate personal data to be rectified.
- I want my personal data to be erased or destroyed under the conditions of KVKK Article 7.
- I want rectification, erasure or destruction to be notified to the third parties to whom my personal data has been transferred.
- I believe that a result against me has arisen from the analysis of my processed data exclusively by automated systems, and I object to it.
- I claim compensation for damage I suffered as a result of the unlawful processing of my personal data.
You do not need to apply to withdraw your explicit consent: you can withdraw your consent to analytics cookies on the website at any time through the “Cookie preferences” link at the bottom of the site, and your consent to commercial messages through the opt-out link in those messages. You may also state these requests in Section 6 if you wish.
6. Description of the request
Please describe your request clearly. For example: which data, period, account or workspace the request concerns; for a rectification request, what the correct information is; for a compensation claim, the nature of the damage. Please attach any information and documents supporting your request.
7. How you want to receive the response
Please state how you would like to receive the response:
- By post to the notification address I provided.
- Electronically to the e-mail address I provided.
- To my KEP address.
If you do not choose, the response is sent through the channel the application came from.
8. Declaration and signature
Please add the following declaration at the end of your application:
“I declare that the information given above is accurate and up to date, and that the application concerns personal data relating to me or that I am making it as an authorised representative. I understand that Fidkeep may request additional information and documents to verify my identity in order to conclude my application, and that my application will be assessed under the Communiqué on the Procedures and Principles of Application to the Data Controller.”
- Applicant's first and last name
- Date of application
- Signature: Wet signature for written applications; for electronic applications, a secure electronic signature, mobile signature, KEP or sending from the registered e-mail address.
9. Identity verification
To prevent personal data from being disclosed to unauthorised persons, we verify the applicant's identity. For this purpose, as permitted by the Communiqué, we may ask you for additional information or documents and ask you questions to clarify your application. For example, we may ask you to confirm an application made from your registered e-mail address by replying to an e-mail we send to that address, or, for applications made through a representative, request the original or a certified copy of the document evidencing authority. The information requested is limited to what is necessary to verify your identity.
10. Response time and fees
Your application is concluded free of charge as soon as possible depending on the nature of the request and within 30 days at the latest from the date it reaches Fidkeep. If the action requires an additional cost, the fee in the tariff set by the Personal Data Protection Board (the “Board”) may be charged. If the application arises from Fidkeep's error, any fee charged is refunded.
Fidkeep accepts your request or rejects it with reasons and notifies you of its response in writing or electronically. If the request is accepted, it is carried out.
Records of your application are kept for 3 years after the application is concluded, as stated in the KVKK Privacy Notice.
11. Grounds for rejection
Your application may be rejected in whole or in part, with reasons, in particular where:
- The identity of the applicant or their authority to apply on someone else's behalf cannot be verified.
- The application does not contain the mandatory elements listed in Article 5 of the Communiqué and the gap is not remedied despite a request.
- The request does not concern the rights under KVKK Article 11.
- The request falls within the exceptions set out in KVKK Article 28.
- For an erasure or destruction request, a legal obligation requiring retention or another processing condition under KVKK Article 5(2) continues to apply (for example the obligation to keep invoice records for 10 years).
- Fulfilling the request would infringe the rights and freedoms, trade secrets or personal data of other people.
- The request is manifestly unfounded or constitutes an abuse of rights.
If your request concerns data for which Fidkeep is a data processor rather than the data controller, it is not rejected; it is forwarded to the relevant data controller as described in Section 12.
12. Reviews in a customer's workspace
When your Google reviews are synchronised into the Fidkeep workspace of the business you reviewed, that business is the data controller for this data; Fidkeep acts only as data processor on the business's behalf. We therefore recommend that you send requests concerning this data directly to the relevant business.
If you apply to Fidkeep, we forward your application to the relevant customer business without undue delay, inform you that we have done so and, under the Data Processing Agreement, help the business respond to your application. The decision on the merits of the application rests with the relevant business. Editing or deleting your review on Google is subject to Google's own rules.
13. Complaint to the Board
If your application is rejected, you find the response insufficient or no response is given in time, you may, under KVKK Article 14, lodge a complaint with the Board within 30 days of learning of the response and in any event within 60 days of the application date. A complaint to the Board can only be made after first applying to Fidkeep.
